ahore High Court Justice Shams Mehmood Mirza on Tuesday issued notice
to the federal government on a petition challenging decision to make NEPRA subservient
to the Water and Power Ministry.
The judge sought reply from the government until January 9, 20
17.
Petitioner Sheraz Zaka said that the government through a notification gave the control of NEPRA
to the ministry in violatio
n of law. He said that
the impugned notification was issued without getting approval from the Council of Common Interest and cabinet.
He claimed that the notification was in violation of Article 154 of the constitution. He requested that as the notification was issued without fulfilling the legal requirement, so it should be declare as null and void.
